Terms of Service

1. Using Our Apps

You may use our apps only in compliance with applicable law and these Terms. You are responsible for submitted images, prompts, and other content and must have the rights and permissions needed to process them. Features and data practices vary by app.

2. AI Features and Explicit Consent

Some of our apps offer optional AI features requiring server-side processing by Deep-Image AI (Deep-Image.AI Sp. z o.o.). Before sending selected personal content, the applicable app identifies what is sent, the recipient, the processing purpose, and requests your explicit permission.

Selected images may contain facial imagery or other personal information. If you decline or withdraw consent, the app will not transmit new personal content for cloud AI processing unless you consent again. See our Privacy Policy.

3. AI Results

AI-generated or edited outputs may be inaccurate, unexpected, or unsuitable for a particular purpose. Review results before using or sharing them. Do not use our apps for deceptive impersonation, fraud, harassment, unlawful surveillance, or illegal or harmful activity.

4. Your Content

You retain ownership of your content. You grant the applicable app and necessary processing providers limited permission to transmit and process selected content solely to provide the feature you request, operate the service, prevent abuse, and comply with law.

5. Credits, Purchases, and Subscriptions

Some features require consumable credits, a one-time purchase, or an auto-renewing subscription purchased through Apple. The App displays the price, billing period, included benefits, and any free-trial terms before confirmation. Payment is charged to your Apple Account when you confirm the purchase.

Auto-renewing subscriptions continue for the displayed period until cancelled. Apple may charge your account for renewal within 24 hours before the current period ends. Manage or cancel subscriptions in your Apple Account settings. Cancellation normally takes effect at the end of the paid period; deleting the App does not cancel a subscription. Any trial converts to a paid subscription unless cancelled before it ends, as disclosed at purchase. Apple handles billing and refund eligibility under App Store rules.

6. Third-Party Services

The app relies on providers including Deep-Image AI, Google Firebase, Google AdMob, and Apple. Availability may depend on those services, and their terms and privacy practices may also apply.

7. License and Intellectual Property

Our Apps, interfaces, branding, and developer-provided content are owned by or licensed to Farida Afrose. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use an App on Apple-branded products you own or control as permitted by the App Store Usage Rules, including through Family Sharing where applicable. No ownership rights are transferred. You may not copy, sell, sublicense, reverse engineer, modify, or distribute an App except where applicable law expressly permits it.

8. Acceptable Use

• Do not upload content you lack permission to use.
• Do not create unlawful, abusive, exploitative, fraudulent, or rights-infringing content.
• Do not interfere with the app, circumvent limits, or misuse the service.
• Do not use face-related tools to mislead others, violate consent, or impersonate a person unlawfully.

9. Disclaimer and Limitation

Each App is provided “as is” and “as available” to the extent permitted by law. We do not guarantee uninterrupted operation, preservation of locally stored projects, or accurate or error-free AI output. Keep independent backups of important work. To the fullest extent permitted by law, Farida Afrose is not liable for indirect, incidental, special, exemplary, or consequential loss arising from App use. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

10. Age and Children

ABC Kids is intended for children and families and should be used with parent or guardian involvement. For Apps not identified as child-directed, you must be at least 13 or the minimum digital-consent age in your country. If you are under the legal age of majority, a parent or guardian must review and accept these Terms for you.

11. Apple App Store Terms

These Terms are between you and Farida Afrose, not Apple. Farida Afrose, not Apple, is responsible for the Apps and their content, maintenance, support, warranties, and addressing claims relating to an App, including product-liability, legal-compliance, and intellectual-property claims, to the extent required by law. Apple has no obligation to provide maintenance or support.

If an App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as permitted by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section. You must comply with applicable third-party agreements when using an App.

12. Export and Legal Compliance

You represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government restricted-party list. You must comply with applicable export controls, sanctions, and local laws.

13. Changes, Suspension, and Termination

You may stop using an App at any time. We may suspend access where reasonably necessary for security, legal compliance, service protection, or serious or repeated violations. Features may change or be discontinued. We may update these Terms; material changes will be posted with a new effective date and additional notice where required.

14. Governing Law, Severability, and Contact

These Terms are governed by the laws of Bangladesh, without overriding mandatory consumer protections that apply where you live. If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement concerning the Apps.
